TERMS AND CONDITIONS

These Terms and Conditions govern membership of YRK FC, participation in activities organised by YRK Football Group LTD and use of the website at www.yrkfc.co.uk.
By registering, booking, paying for or participating in a YRK activity, you confirm that you have read and accepted these Terms and Conditions. Where the participant is under 18, their parent or legal guardian must accept these terms on their behalf.
1. ABOUT YRK
YRK Football Group LTD operates YRK FC, including league teams, casual football sessions, training, tournaments, charity matches, community events, youth activities and other football opportunities.

References to “YRK”, “YRK FC”, “the club”, “we”, “us” or “our” mean YRK Football Group LTD.
References to a “participant” include players, members, parents, guardians, volunteers and anyone booking or attending a YRK activity.
2. ELIGIBILITY AND REGISTRATION
Participants must provide accurate, complete and current information when registering with YRK, Spond, The Football Association, an affiliated league or another relevant organisation.
League players must complete all required registration, membership and payment requirements before they can be considered for selection.
Submitting a registration, paying a fee or joining a Spond group does not guarantee:

A permanent squad place.
-
Selection for a match or activity.
-
A particular amount of playing time.
-
Selection in a preferred position.
-
Continued membership of a team or group.
Participants must notify YRK of any changes affecting their eligibility, contact information, medical circumstances or ability to participate safely.
YRK may refuse or cancel a registration where information is incomplete, inaccurate or misleading, or where participation would breach competition rules, safeguarding requirements or the reasonable interests of the club.
3. PARTICIPANTS UNDER 18
Participants under 18 must have the consent of a parent or legal guardian.
Parents and guardians are responsible for:

Providing accurate emergency-contact and relevant medical information.

Ensuring information remains current.
-
Informing YRK of any additional support requirements.
-
Ensuring the young person arrives and leaves in accordance with the arrangements for the activity.

Making payments and accepting booking terms on the young person’s behalf.
Youth activities will be operated in accordance with YRK’s safeguarding responsibilities and applicable Football Association requirements.
Safeguarding concerns should be raised immediately with the relevant YRK safeguarding contact. Where someone is at immediate risk, emergency services or the appropriate authority should be contacted without delay.
4. SPOND AND CLUB COMMUNICATION
YRK uses Spond to manage memberships, bookings, availability, payments and official club communication.
Participants are responsible for:

Joining the correct Spond group.
-
Keeping their personal information current.
-
Responding to availability requests by the stated deadline.
-
Checking fixture, venue and session information.
-
Reading updates and cancellation notices.
-
Making required payments when due.
WhatsApp, email and social media may be used for additional communication. Unless YRK states otherwise, official bookings, payments and availability are managed through Spond.
YRK is not responsible for a participant missing information because they have not checked Spond, supplied incorrect contact details or disabled relevant notifications.
5. CASUAL GAMES AND SESSION BOOKINGS
Places at casual games, training sessions and other bookable activities are subject to availability.
A place is not secured until the required booking and payment have been completed, unless an organiser has expressly agreed otherwise.
Participants must not attend a full or invitation-only activity unless they have secured a place or received permission from the organiser.
Bookings must not be transferred to another person without approval from YRK.
Participants are responsible for selecting the correct event, venue, date and time before confirming their booking.
6. PAYMENTS
All payments must be made through Spond or another payment method approved by YRK.
Participants are responsible for paying:

Session and match fees.
-
Membership and registration fees.
-
Monthly subscriptions.
-
Kit and equipment charges.
-
Competition fines where applicable.
-
Any other clearly communicated club charges.
Failure to pay by the stated deadline may result in suspension from training, matches, bookings or selection until the account is brought up to date.
Repeated non-payment may result in the participant’s ability to book future activities being paused or their membership being reviewed.
Anyone experiencing genuine financial difficulty should contact YRK as early as possible. Any alternative arrangement must be agreed in advance and is not automatic.
7. LEAGUE-TEAM SUBSCRIPTIONS
League-team subscriptions are charged for the period communicated by YRK.
Subscriptions contribute towards the club’s overall seasonal costs, including:

Training facilities.
-
Home-match facilities.
-
Referees and officials.
-
League and cup fees.
-
Insurance.
-
Equipment.
-
Administration.
-
Other reasonable team and club operating costs.
Subscriptions are not calculated according to individual attendance. Missing a match, training session or other activity does not normally entitle a player to a reduction, credit or refund.
A player with a serious long-term injury or exceptional circumstances may request an exemption from future payments. Any exemption must be agreed by YRK and will not normally apply retrospectively.
Players wishing to leave a league team must notify YRK before their next subscription becomes due. Any outstanding payments remain payable.
8. REGISTRATION, MEMBERSHIP AND SIGNING-ON FEES
Registration, membership and signing-on fees are non-refundable once a registration has been submitted, accepted or processed by YRK, The Football Association, an affiliated league or another competition body, except where required by law.
Payment does not guarantee selection, playing time or a permanent place within a squad.
If YRK cannot complete a registration, any refund will take account of third-party fees and reasonable costs that cannot be recovered.
9. CANCELLATIONS BY PARTICIPANTS
Unless different terms are clearly stated for a particular activity:

Cancellations made more than 24 hours before the scheduled start time may receive a credit for a future YRK session.
-
Cancellations made within 24 hours of the scheduled start time are non-refundable and will not normally receive credit.

Participants who fail to attend without cancelling remain responsible for the full payment.
-
Credits cannot normally be exchanged for cash or transferred to another person.
Exceptions may be considered in serious or exceptional circumstances at YRK’s reasonable discretion.

10. CANCELLATIONS OR CHANGES BY YRK
YRK may cancel, postpone, relocate, shorten or rearrange an activity because of:

Severe weather.
-
Unsafe playing conditions.
-
Facility availability.
-
Insufficient participant numbers.
-
Competition requirements.
-
Staff or organiser availability.
-
Circumstances outside YRK’s reasonable control.
Where YRK cancels a separately paid session, participants will normally receive either a credit or a refund for that activity.
Where an activity is rearranged, the original payment will normally be transferred to the new date, time or venue.
League-team subscriptions will not normally be reduced because an individual fixture or training session is cancelled, postponed or rearranged, as subscriptions contribute towards the club’s overall seasonal costs.
YRK is not responsible for additional expenses such as travel, accommodation or personal equipment costs unless required by law.
11. PLAYER AVAILABILITY AND SELECTION
League players must submit availability by the deadlines communicated by the coaching team.
Selection may reasonably take account of:

Availability and communication.
-
Attendance and punctuality.
-
Fitness and readiness to play.
-
Position and tactical requirements.
-
Conduct and attitude.
-
Registration and payment status.
-
Competition rules.
-
The needs of the team and wider club.
Membership, registration or payment does not guarantee selection, playing time or selection in a particular position.
Coaches and club management retain reasonable discretion over squads, team selection, roles and playing decisions.
12. CONDUCT AND DISCIPLINE
Everyone involved with YRK must behave respectfully towards teammates, opponents, coaches, officials, volunteers, venue staff, spectators and members of the public.
YRK will not tolerate:

Threatening, abusive or discriminatory behaviour.
-
Bullying, harassment or intimidation.
-
Violence or deliberate dangerous conduct.
-
Damage to facilities, kit or equipment.
-
Serious or repeated breaches of club or competition rules.
-
Conduct that creates a safeguarding risk.
-
Conduct likely to cause serious harm to YRK, its participants or its reputation.
Where appropriate, YRK may:
-
Issue a warning.
-
Remove someone from an activity.
-
Suspend participation or selection.
-
Restrict access to Spond groups or club communication.
-
Terminate membership.
-
Report a matter to The Football Association, an affiliated competition, a venue, safeguarding authorities or the police.
Any Football Association or competition fine applied because of an individual’s conduct may remain that individual’s responsibility.
Where reasonably practicable, YRK will explain the reason for serious disciplinary action and allow the participant an opportunity to respond.
13. HEALTH, INJURIES AND PARTICIPATION
Football is a physical activity that carries an inherent risk of injury.
Participants are responsible for deciding whether they are fit to participate and must inform the organiser of any injury, medical condition or other relevant concern that may affect their safety or the safety of others.
Participants must not take part against medical advice.
YRK may prevent or stop someone from participating where there are reasonable concerns about their health, fitness, conduct or safety.
Participants are responsible for wearing suitable footwear, clothing, shin guards and any other safety equipment required for the activity or playing surface.
Nothing in these Terms and Conditions excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence.
14. PERSONAL PROPERTY
Participants are responsible for their own clothing, equipment, valuables and personal belongings.
YRK is not responsible for loss, theft or damage unless it results from YRK’s negligence or another liability that cannot legally be excluded.
Participants should not leave valuable items unattended at training grounds, match venues or other facilities.
15. KIT AND CLUB EQUIPMENT
Participants are responsible for looking after any kit or equipment issued to them.
Club-owned items must be returned when reasonably requested. A participant may be charged for club property that is deliberately damaged, lost or not returned.
Personalised, printed or specially ordered kit cannot normally be cancelled or refunded once the order has been placed, except where the item is faulty, damaged, incorrectly supplied or another statutory right applies.
Items purchased directly from an external club-shop provider are also subject to that provider’s terms and returns policy.
16. PHOTOGRAPHY AND MEDIA
YRK may photograph or film matches, training sessions and club events for legitimate club, promotional, reporting and historical purposes.
Where consent is legally required, particularly in relation to children and young people, YRK will seek appropriate permission.
Participants and parents or guardians may raise a concern or request regarding photography or media use by contacting YRK. Requests will be considered in accordance with safeguarding, privacy and data-protection requirements.
YRK cannot control photographs or recordings independently created by spectators, opponents, leagues, venues, media organisations or other third parties.
17. THIRD-PARTY SERVICES
YRK may use or provide links to third-party services, including:

Spond.
-
The Football Association.
-
Affiliated leagues and competitions.
-
Payment providers.
-
Facility operators.
-
Kit and equipment suppliers.
-
Sponsors and partners.
-
Social-media platforms.
Third-party organisations operate under their own terms, policies and privacy notices.
YRK is not responsible for third-party websites, systems, transactions or services outside its reasonable control.
18. WEBSITE USE AND INTELLECTUAL PROPERTY
Website content is provided for general information and may be updated without notice.
Users must not:

Misuse or interfere with the website.
-
Attempt unauthorised access.
-
Introduce malicious code.
-
Copy or commercially exploit YRK content without permission.
-
Falsely represent an association with YRK.
-
Use YRK branding in a misleading, unlawful or damaging manner.
The YRK name, badge, designs, photographs and original website content belong to YRK Football Group LTD or their respective owners. Nothing on the website grants permission for commercial reuse without prior written approval.
19. DATA PROTECTION
Personal information is handled in accordance with the YRK Privacy Policy and applicable UK data-protection law.
Information may be shared with organisations such as Spond, The Football Association, affiliated competitions, insurers, payment providers, safeguarding authorities and facility operators where reasonably necessary to:

Administer football activities.

Process payments and registrations.
-
Meet legal or competition obligations.
-
Protect participants.
-
Respond to emergencies.
-
Investigate conduct or safeguarding concerns.

20. SUSPENSION OR TERMINATION
YRK may suspend or terminate participation or membership where there is a reasonable basis to do so, including:

Serious or repeated misconduct.

Persistent non-payment.
-
Repeated failure to follow booking or availability procedures.
-
Safeguarding or safety concerns.
-
Providing false or misleading information.
-
Serious damage to club property or reputation.
-
Breach of these Terms and Conditions.
-
Breach of Football Association, league, competition or venue rules.
Ending a membership does not automatically cancel charges that were already due or relate to a membership period that has already begun.
Any refund or credit will be considered under the Refund and Cancellation Policy and applicable consumer law.
21. COMPLAINTS AND CONCERNS
Operational concerns should initially be raised with the relevant session organiser, coach or team official where appropriate.

Complaints should include:

The outcome being requested.
Safeguarding concerns should be reported immediately through YRK’s safeguarding procedure or to the appropriate authority where someone may be at risk.
22. CHANGES TO THESE TERMS
YRK may update these Terms and Conditions when its activities, policies, prices, systems or legal obligations change.
The current version will be published on the YRK website with the latest revision date.
Where reasonably practicable, material changes affecting an existing paid membership will be communicated to the affected participants.
23. SEVERABILITY
If any part of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.
24. GOVERNING LAW
These Terms and Conditions are governed by the laws of England and Wales.
Nothing in these terms affects any statutory consumer rights or other legal rights that cannot lawfully be excluded or restricted.
